Terms of Service for Valt Driver App

1. Who We Are

Valternative Energy (Pty) Ltd is a registered South African company providing electric-mobility solutions, fleet management systems, energy infrastructure, and digital platforms for professional drivers and fleet partners.

2. Eligibility & Account Registration

To use the Valt Driver App, you must:

• Be 18 years or older
• Hold a valid driver’s licence and any required professional permits
• Have the legal capacity to enter into a binding agreement
• Complete the onboarding and verification process required by Valternative

You agree to provide accurate, current, and complete information during registration and to keep your details up to date.

3. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity conducted through your account
• Ensuring your use of the App complies with these Terms and applicable laws

You must not:

• Share your account with another person
• Impersonate another driver or entity
• Use the App in a fraudulent, misleading, or unlawful manner

Valternative may suspend or terminate your account if these obligations are breached.

4. Acceptable Use

You agree to use the Valt Driver App only for its intended purposes within the Valternative mobility ecosystem.

You may not:

• Interfere with the security or performance of the App
• Attempt to access systems or data without authorisation
• Reverse engineer, copy, scrape, or exploit any part of the App
• Upload malicious code or disrupt services
• Harass, threaten, or abuse Valternative staff, partners, or other drivers

5. Driver Status & Relationship

Use of the Valt Driver App does not create an employment relationship between you and Valternative.

Drivers operate as independent contractors or partners, subject to separate commercial or fleet agreements where applicable.

Nothing in these Terms constitutes:

• An employment contract
• A partnership or joint venture
• An agency relationship

6. Earnings, Payments & Financial Information

Where applicable:

• Earnings, deductions, rentals, and usage charges will be displayed in-app
• Payments are processed through approved banking or payment partners
• You authorise Valternative to process deductions and settlements as disclosed

Valternative does not guarantee minimum earnings unless expressly stated in writing as part of a specific programme or promotion.

7. Intellectual Property

All intellectual property relating to the App, including:

• Software
• Interfaces
• Designs
• Logos and branding
• Data models and dashboards

is owned by or licensed to Valternative.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App solely for its intended purpose.

You may not copy, modify, distribute, or commercially exploit any part of the App without written permission.

8. Data & Privacy

Your use of the Valt Driver App is governed by our Privacy Policy, available at:

By using the App, you consent to the collection, processing, and storage of your data as described in that policy.

9. App Availability & Changes

Valternative may:

• Update or modify App features
• Perform maintenance that temporarily limits access
• Suspend or discontinue parts of the App

We do not guarantee uninterrupted or error-free operation.

10. Suspension & Termination

A. By You

You may stop using the App at any time and request account deletion as outlined in the Privacy Policy.

B. By Valternative

We may suspend or terminate your access if:

• You breach these Terms
• You violate legal or regulatory requirements
• Continued access poses operational, legal, or security risk

Termination does not remove obligations incurred prior to termination.

11. Disclaimers

The Valt Driver App is provided “as is” and “as available.”

Valternative makes no warranties regarding:

• Earnings outcomes
• App availability or performance
• Accuracy of third-party integrations (e.g. maps, payments)

Use of the App is at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law:

• Valternative is not liable for indirect, incidental, or consequential damages
• Total liability is limited to amounts paid to you (if any) in the preceding 12 months

Nothing in these Terms limits liability where such limitation is prohibited by law.

13. Indemnity

You agree to indemnify and hold Valternative harmless from any claims arising from:

• Your misuse of the App
• Breach of these Terms
• Violation of law or third-party rights

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of South Africa.

Any disputes shall be subject to the exclusive jurisdiction of South African courts.
